Scope of this Policy
We provide Services to our customers. As part of the Services, customers upload their data onto Ad-Juster’s computer systems in furtherance of the processing Services Ad-Juster offers at a customer’s explicit directives. As such, the customer is the data controller and Ad-Juster is the data processor as the customer is the owner of the data collected, uploaded, and processed by Ad-Juster, and Ad-Juster is performing the data processing Services pursuant to the customer’s explicit directives in the form of a written agreement between Ad-Juster and the customer.
Information Collected by Ad-Juster
We collect information about you when you provide it to us, when you use our Services and/or Website, and when other sources provide it to us, as further described below.
Information you provide to us.
Registration and Customer Support Information: You may provide us with information about you when you complete an Ad-Juster web form, register to use an Ad-Juster Website, or Service, request a Services demonstration, respond to an advertisement, contact Ad-Juster for support or other offerings, or attend an event or forum in which Ad-Juster is hosting or participating. During such processes, we collect Personal Information about you. For example, we may collect your name, company name, address, email, phone number, billing and payment information, position, or title. We may also collect other public and third party information about you to supplement your profile, such as public information about the company where you work.
Data required to perform Services: Ad-Juster enables clients to upload their data into their own Ad-Juster account. We use your data file to upload the data contents of that file and process them on our servers. The data contents that you upload is your own for use in the Ad-Juster platform. Ad-Juster does not share data that clients upload into Ad-Juster.
Service request information: Information provided when you request any Services or assistance on or through the Website and/or the Services, available now or in the future, including without limitations: product demo in connection with selected area(s) of interests, or report a problem in connection with your access to or use of the Website and/or the Services.
Correspondence: Records and copies of your correspondence (including e-mail correspondence) if you contact us by any means and for any purposes.
Information we collect automatically when you use the Services or Website
We may receive information about how you use our Website and Services through the use of first-party and third-party cookies, and also web beacons and other similar technologies. Our servers collect similar information when you are logged into our Website or Services. The information we receive through cookies and similar technologies may be associated with you, depending on the Website or Services you are using, and whether you have provided information identifying yourself to the Website or Services.
In addition, third parties may be able to collect information about your online activities when you use our Website or Services using cookies or other technologies.
Other Personally Identifiable Information: Other information by which you may be personally identified or contacted.
Device Information: Information about your device on which you access or use the Website and/or the Services, including the unique device identification number of your device, web IP addresses, web operating system, browser type and version, Internet connection information, referring Website, statistics on page views, search terms, and cookie information.
Location Information: Real-time information about the location of your device. You may opt-out of such collection of location information. Note, however, that opting out of the collection of location information will disable the location-based features of the Website and/or the Services.
Error Information: Any error reporting information if the Website and/or the Services crash or hang up for the sole purposes of investigating and remedying the errors and improving the Website and/or the Services. Such error reports contain information about the type and version of your device and browser, the device identifier, and time, features being used, and the state of the Website and/or the Services when the error occurs. Any personally identifiable information is only included incidentally, if at all, in such error reports.
Information we collect on, or receive from, third parties and their related platforms
We receive information about you from from third party Services and from our business and channel partners.
Ad-Juster social networking pages: We maintain pages on many social networking sites. We may collect information when you interact with our social networking pages.
Ad-Juster online advertising: We advertise online, including displaying Ad-Juster ads across the Internet on Website and in apps. When we advertise online to you, we may collect information about which ads are displayed to you, which ads you click on, and the web page where the ad was displayed to you.
Information from Third Parties: Information provided or made available by any public databases, joint marketing partners, social media platforms, as well as from other third parties, including without limitations: information about your preferences provided by third party analytics tools.
Use of the information collected by Ad-Juster
Provide you Ad-Juster Website content and Services, as well as any other Services, support, or information you have requested;
Operate and improve our Website and Services, and diagnose related problems
Personalize our Website, Services, and Communications to your likely interests and needs;
Send you business messages such as those related to Services notifications, payments or renewal of your subscription;
Send you information about Ad-Juster, new releases, special offers, and similar marketing information;
Conduct market research about our customers, their interests, and the effectiveness of our marketing campaigns;
Display personalized ads to you;
Combine information we collect about you with other public or private information sources in order to provide you with Communications that may be relevant to you and to enhance the Services we provide to you;
Contact you via telephone to discuss our Services and related offers with you;
Aggregate data from our Services used for benchmarking and to improve our Services;
Where required under applicable law, we will obtain your consent for the use of your Personal Information for marketing purposes.
Sharing information collected by Ad-Juster
We work with companies that help us run our business. These companies may provide Services such as delivering customer support, processing and collecting payments, and sending Communications on our behalf. These companies may have access to your Personal Information as required to help us run our business. Ad-Juster may also share your Personal Information:
When you have consented to the sharing;
With our affiliated companies;
When you purchase a license to use, or indicate interest in, a third party product or service through Ad-Juster, so the third party may contact you about your purchase or interest;
With our resellers and other sales partners;
To contractors, service providers, and other third parties we use to support our Services or business or Communications, and who are bound by contractual obligations to keep your personal information confidential and to use it only for the purposes for which we disclose it to them;
When we are required or believe we are required to provide information in response to a subpoena, court order, applicable law, government statute, regulation or other legal process;
When we have a good faith belief that the disclosure is necessary to prevent or respond to fraud, defend our Website or Services against attacks, or protect the property and security of Ad-Juster, or the property and security of our customers and users;
To the extent necessary to meet lawful requests by public authorities, including to meet national security or law enforcement requirements;
- If we merge with or are acquired by another company, we sell a Website, app, or business unit, or all or a substantial portion of our assets are acquired by another company, in which case your information may be one of the assets that is transferred;
- When we hire companies to help us market our Website and Services and provide you with information and offers related to Ad-Juster, including displaying ads to you across the Internet;
- When we enlist the Services of participating third party carriers to provide messaging Services or otherwise support our Communications;
- When we aggregate and share de-identified information collected by our Services in order to provide statistical information or market research to third parties;
- To fulfill any other purpose for which you provide it;
- With your consent;
Ad-Juster does not share data that clients upload into Ad-Juster for performance of Services.
Information security and storage
We understand that the security of your Personal Information is important. We implement reasonable administrative, technical, and physical security controls designed to protect your Personal Information from loss, misuse, unauthorized access, disclosure, alteration, or destruction. However, despite our efforts, no security controls are completely effective and we cannot ensure or warrant the security of your Personal Information.
Your Personal Information and data files are stored on our servers and the servers of our affiliated companies and companies we hire to provide Services to us.
How long we keep information
How long we keep information we collect about you depends on the type of information, as described in further detail below. After such time, we will either delete or anonymize your information or, if this is not possible (for example, because the information has been stored in backup archives), then we will securely store your information and isolate it from any further use until deletion is possible.
Account information: We retain your account information until you delete your account. We also retain some of your information as necessary to comply with our legal obligations, to resolve disputes, to enforce our agreements, to support business operations and to continue to develop and improve our Services. Where we retain information for Service improvement and development, we take steps to eliminate information that directly identifies you, and we only use the information to uncover collective insights about the use of our Services, not to specifically analyze personal characteristics about you.
Information you share on the Services: If your account is deactivated or disabled, some of your information and the content you have provided will remain in order to allow your team members or other users to make full use of the Services.
Managed accounts: If the Services are made available to you through an organization (e.g., your employer), we retain your information as long as required by the administrator of your account.
Marketing information: If you have elected to receive marketing emails from us, we retain information about your marketing preferences unless you specifically ask us to delete such information. We retain information derived from cookies and other tracking technologies for a reasonable period of time from the date such information was created.
Reviewing, updating or deleting your Personal Information
You have certain choices available to you when it comes to your information. Below is a summary of those choices, how to exercise them and any limitations. We will respond to requests about this within a reasonable timeframe.
You have the right to request a copy of your information, to object to our use of your information (including for marketing purposes), to request the deletion or restriction of your information, or to request your information in a structured, electronic format. Below, we describe the tools and processes for making these requests. You can exercise some of the choices by logging into the Services and using settings available within the Services or your account. Where the Services are administered for you by an administrator, you may need to contact your administrator to assist with your requests first. For all other requests, you may contact us as provided in the Contact Us section below to request assistance.
Your request and choices may be limited in certain cases: for example, if fulfilling your request would reveal information about another person, or if you ask to delete information which we or your administrator are permitted by law or have compelling legitimate interests to keep. Where you have asked us to share data with third parties, you will need to contact those third-party service providers directly to have your information deleted or otherwise restricted. If you have unresolved concerns, you may have the right to complain to a data protection authority in the country where you live, where you work or where you feel your rights were infringed.
Access and update your information: Our Services give you the ability to access and update certain information about you from within the Service. You can update your profile information within your profile settings and modify content that contains information about you using the editing tools associated with that content.
Deactivate user account: You or an administrator can deactivate your user account. If you can deactivate your own access, that setting is available to you in your account settings. Otherwise, please contact your administrator. Please be aware that deactivating user access to an account does not delete your information from that account; your information remains visible to other Service users based on your past participation within the Services. For more information on how to delete your information, see below.
Delete your information: Our Services give you the ability to delete certain information about you from within the Service. For example, you can remove certain profile information within your profile settings. Please note, however, that we may need to retain certain information for record keeping purposes, to complete transactions or to comply with our legal obligations.
Request that we stop using your information: In some cases, you may ask us to stop accessing, storing, using and otherwise processing your information where you believe we don't have the appropriate rights to do so. Where you gave us consent to use your information for a limited purpose, you can contact us to withdraw that consent, but this will not affect any processing that has already taken place at the time. You can also opt-out of our use of your information for marketing purposes by contacting us, as provided below. When you make such requests, we may need time to investigate and facilitate your request. If there is a delay or dispute as to whether we have the right to continue using your information, we will restrict any further use of your information until the request is honored or the dispute is resolved, provided your administrator does not object (where applicable). If you object to information about you being shared with a third-party app, please disable the app or contact your administrator to do so.
Opt out of communications: You may opt out of receiving promotional communications from us by using the unsubscribe link within each email, updating your email preferences within your Service account settings menu, or by contacting us by sending an email to privacy@Ad-Juster.com with "Unsubscribe" in the body, together with a description of the Communications you no longer desire to receive. Even after you opt out from receiving promotional messages from us, you will continue to receive transactional messages from us regarding our Services. You can opt out of some notification messages in your account settings. Please note, you will continue to receive generic ads.
You may be able to opt out of receiving personalized advertisements from other companies who are members of the Network Advertising Initiative or who subscribe to the Digital Advertising Alliance's Self-Regulatory Principles for Online Behavioral Advertising. Turn off Cookie Controls: Relevant browser-based cookie controls are described in the next section.
Send "Do Not Track" Signals: Some browsers have incorporated "Do Not Track" (DNT) features that can send a signal to the Website you visit indicating you do not wish to be tracked. Because there is not yet a common understanding of how to interpret the DNT signal, our Services do not currently respond to browser DNT signals. You can use the range of other tools we provide to control data collection and use, including the ability to opt out of receiving marketing from us as described above.
How are cookies used for advertising purposes?
Cookies and other ad technology such as beacons, pixels, and tags help us market more effectively to users that we and our partners believe may be interested in Ad-Juster. They also help provide us with aggregated auditing, research, and reporting, and know when content has been shown to you.

You may opt-out of third party cookies from Google Analytics on its Website.
You can opt out of interest-based targeting provided by participating ad servers through the Digital Advertising Alliance (http://youradchoices.com). In addition, on your iPhone, iPad or Android, you can change your device settings to control whether you see online interest-based ads.
If you limit the ability of Website and applications to set cookies, you may worsen your overall user experience and/or lose the ability to access the Services, since it will no longer be personalized to you. It may also stop you from saving customized settings, like login information.
You may also submit a request to us to review, edit, or delete your Personal Information by emailing your request to privacy@Ad-Juster.com, or if you prefer, you can contact us through physical mail at Ad-Juster, Inc., 13280 Evening Creek Rd, Suite 100 San Diego CA 92128 (Attn: Privacy). Once we verify your identify, we will assist you with your request.
We will retain your Personal Information for as long as necessary to provide you with the Website and Services you use, as needed to comply with our legal obligations or enforce our agreements. For example, we may retain certain records for legal or internal business reasons, such as fraud prevention. Some of your information may also remain on backup systems after your use of our Website and Services ends.
You can choose not to provide us with your Personal Information, but if you do not provide us with your Personal Information when we request it, we may not be able to provide you with the Website and Services you use, or tailor them to you.
Policy Regarding Children
The Website is not directed to children under the age of thirteen (13) and we do not knowingly collect personally identifiable information from children under the age of thirteen (13). If we become aware that we have inadvertently received personally identifiable information from a user under the age of thirteen (13), we will delete such information from our records. If we change our practices in the future, we will obtain prior, verifiable parental consent before collecting any personally identifiable information from children under the age of thirteen (13).
Your California Privacy Rights
California Civil Code Section § 1798.83 permits users of our Website that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes.
